Bills might yet pursue legal action against phone-call pranksters

PHOENIX – The Buffalo Bills might yet pursue legal action against the two 20-year-old pranksters who surreptitiously set up, then secretly recorded, GM Buddy Nix’s phone conversation with Tampa Bay Bucs GM Mark Dominik on March 8.

Deadspin.com posted the recording last Tuesday.

According to U.S. legal experts, the pranksters probably broke state and federal laws in recording a telephone conversation without either GM’s consent.

The First Amendment probably protects the website from legal culpability.

“We’ve obviously met with our attorney regarding the situation and the breach of privacy, and we will continue to see what options are out there from a legal standpoint,” Bills president and CEO Russ Brandon said Monday night at the NFL annual meeting at the Arizona Biltmore hotel.

In an earlier interview, Nix said he “thinks the league will pursue it. We will pursue it.”

Nix and Dominik talked mostly harmless shop for six minutes, unaware the pranksters were listening to or recording their conversation.

Obviously, though, it was incredibly embarrassing for Nix. He’d phoned the pranksters, thinking he was returning Dominik’s call. The pranksters put Nix on speakerphone to actually talk to Dominik, whom they’d called on another line. The duo listened and recorded the conversation between the two unknowing GMs.

“It’s something that’s an alert for all of us, and probably an eye-opening event for me and everybody else,” Nix said. “You never know. I’m just thankful that it wasn’t something bad said, or derogatory said. It makes you realize that you can’t be too careful.”

The hurdle in seeking legal redress is in knowing who the pranksters actually are. Deadspin did not, and has not, identified the daring duo by name, or even home state.
