How can a birth be “wrongful”?

- September 23rd, 2011

This story has been out there for a while now and it still just makes me shake my head. Parents give birth to their son, realize he has birth defects and then sue because if they’d known they would have killed him before he was born. From LifeNewscom.

“A Florida couple will receive $4.5 million after winning a wrongful birth lawsuit claiming their son, born with no arms and one leg, should have become a victim of abortion. They complained the doctor in the case should have detected the physical disabilities before birth and suggested an abortion.”

The story could have been headlined, “Mother thinks son better off dead but will still take money.”

I feel for the parents Ana Mejia and Rodolfo Santana and their three year-old son Bryan but other than making it easy to pay the bills, I don’t know what this lawsuit accomplishes.

Just goes beyond all common sense. Can I sue the dairy association because the cheese I ate gave me constipation. there doesn’t seem to be much you can’t sue for today.

The only thing sicker than the couple is the judge that made the award.

I think we would be a lot better off if we didn’t hear about this sort of shit. We all know the world is filled with human trash and insanity, but we don’t need to know their names and what they do. I don’t need that, because I simply don’t care what other people do to each other anymore.

We have jumped the shark as a culture so this is just part of the long slide to oblivion … give or take an arm or a leg or a few million for no good reason.

First, with no arms and one leg, making it easier to ‘pay the bills’ is a big, BIG deal.
    -
Second, ‘what else is accomplished’ is the punishment of medical negligence and or malpractice.

Whether they’d choose an abortion or not, in this day and age of advanced, technological prenatal care, the doctor[s] should have seen this coming.

This should not have been a ‘surprise’ birthday.

    Great show on SunTV…

I am surprised they didn’t want a retroactive abortion.

No matter how you look at it abortion is just a pretty word for MURDER.

Ever heard of Nick Vujicic? No arms, no legs, no worries? The dude is twice the man most of us will ever be. Guess he (and the world) would be a better place had he been aborted.

That’s who I feel for in this case – the kid. Callous moneygrab it is and will be forever, because even if they love their son and don’t really mean what they say, HE will hear about it the rest of his life, and the scars will most likely lead to a life path of dependency and victimhood beause of it. Nick grew into the man he is because his parents didn’t take the easy road and it inspired him to do the same.

I read recently that Larry Flint (pornographer) has offered 1 million $ to anyone who can find the dirt (sexually) on Mr. Perry of Texas and the Republican candidate.
A similar matter is going on in B.C. w/o the cash award re: B.C. Conservative party, where (one of your own, well he did work for the 24 Hr paper) is dragging a Baptist Pastor’s name through the mud for his belief that same-sex marriage is wrong as is, abortion. Mr. Elley is running for president of the Party, under leader John Cummins.
Alex Tsakumis is attacking him and the Conservatives, hammer and tongs for Elley’s stance on the above. While trying to defend Elley to some degree, I too was insulted and ridiculed by Alex and the pack of jackals that feed off this hatred of more orthodox Christians. I have warned Alex that his blog is in danger of being taken over by leftist radicals, but he is bent on continuing attacks on fellow Christians. (Alex claims to be Christian, going so far as to show a tattooed Ecce Home on his chest?)

Soooo, if he had been found to have only one missing limb would his parents have aborted him? How about if he were only missing a finger? How about if it looked like he might actually be female? This is a slippery slope folks, one which already has it’s share of people living near the bottom of it. I do not agree with abortion, period. That aside the doctor was perhaps negligent if he had any reason to suspect deformity or if SAP was to ultrasound at some point. This brings up the legal aspect: What chance at reparations would exist without the abortion option? The plaintiff had to show that they would have had an option had they known the child’s condition.

I hope the boy never finds out what his parents have done and said. Makes me want to cry.

Eugenics rearing it’s putrid head again. A story like this would have made Hitler and Tommy Douglas proud if it had happened during their days!

Every expectant mother gets an ultrasound these days. How did these “parents” not know their baby was missing a significant number of limbs ?
