Manitoba sex judge just a Canadian copycat

Judge Lori: Stern but fair (we hope)

I know it’s a little hard to wrap your head around, but Manitoba’s Lori Douglas isn’t the first judge to be caught up in a sex scandal involving allegations of sado-masochism, bondage, kinky photos and the various accoutrements and practices of that specialized sexual niche known as BDSM which, I think, stands for Bondage-Domination-(or maybe it’s Discipline)-Sadism-Masochism — correct me if I’m wrong).

And she probably won’t be the last.

Poor Judge Lori. There’s a good chance she’ll lose her job as associate chief justice of the Court of Queen’s Bench (Family Division) of Manitoba over this. (Personally, I think the fact that she has one of those names ending in “i” is a better reason to boot her from the bench, but that’s just my personal prejudice.)

It’s not certain the story of Lori Douglas will unfold in that particular way, but it’s worthwhile looking at the previous case of a judge brought down by a S&M sex scandal to see what the future might hold for Judge Lori.

Koen Aurousseau was a respected judge in the Belgian court of first instance in Mechelen when the private fetishes of Aurousseau and his wife Magda became front-page news across Europe in 1997.

The Aurousseaus had been engaging in progressively more extreme forms of bondage, whipping, group sex and so on — at Magda’s instigation, I might point out — for five years when their relatively private sex life became public, almost by accident.

The judge was the “S” part of the equation while his wife was on the “M” receiving end, so to speak.

When the Aurousseaus’ kinky sex life became public, the judge was charged with physical assault and incitement to prostitution. He was convicted, fired as a judge, lost his house, attempted suicide and generally had a pretty depressing time of it.

Aurousseau tried to have the convictions reversed, taking his case all the way to the European Court of Human Rights, before his appeal was terminally dismissed in 2008.

One thing I find quite interesting — charming, to a certain degree — is that Magda has stuck with Koen through thick and thin (but perhaps that’s just the masochist in her).

A movie about the Aurousseaus’ experience (made with the couple’s co-operation) was released in Europe last year to a mixed reception. It’s highly unlikely the film SM Rechter (Flemish for SM Judge) will ever be released in North America — and that’s probably for the best. I’ve only seen a short trailer for the film on YouTube but it seems to be both graphic and boring — a bad combination.

So here’s my conundrum: If a judge is involved in sado-masochism, is it better for him or her to be on the S side (like Aurousseau) or on the M side (like Judge Lori)?

I know, I know, it’s better that he/she not be involved in S&M altogether, but my gut feeling is that it’s probably better to have a masochistic judge deciding your legal future than a sadistic judge.

At least a masochist would (hopefully) feel your pain — rather than adding to it, as I suspect a sadist would.

There you have it. Perhaps 2010 Manitoba is part of a different world than 1997 Belgium, but I doubt it. I think Judge Lori will probably end up being shafted, so to speak.

Perhaps rightly so. Leaving moral arguments aside, I think we would all agree she seems to have shown a hefty degree of bad judgment — and that really is not a good attribute for someone whose job description is “judge.”

If she has to find a new line of work, perhaps she could get her own TV show — sort of a cross between Judge Judy and Sex Talk With Dr. Ruth. I think people would pay good money to see that little spectacle.

If, on the other hand, she is able to hang onto her judging job, nobody — lawyers, court staff, civilians appearing before her — will ever be able to sit in her courtroom again without thinking about those photos of Judge Lori in her sweaty altogether with the chains and whips and sex toys/tools.

Let that be a lesson for you, kids: Whatever you do in your (supposedly) private life, don’t let anyone take photos of you doing it … or it could someday be far more public than you ever expected.

Just ask Judge Lori.
